DACA Updates

As of December 7, 2020, the District Court announced that immigration has to start receiving and approving first-time requests for DACA cases and renewal requests regardless of the expiration date for those who already have DACA. In addition, the government is extending to 2 years any DACA and employment authorization documents that were initially issued for 1 year.

What is the DACA initiative all about?

The acronym “DACA” actually stands for DACA means Deferred Action for Childhood Arrivals. It is a policy created by then-President Obama on June 15, 2012, that allows certain undocumented young people who entered the  United States as children to receive a renewable two-year period of deferred action from deportation and become eligible for a work permit in the U.S.

In plain terms, DACA is the program that protects young immigrants from been deported out of the United States.

How Do I Apply For DACA?

Just like every other program with rules, DACA’s criteria for application are as follows:

  • You are under 31 years of age as of June 15, 2012;
  • Came to the U.S. while under the age of 16;
  • You were physically present in the United States on June 15, 2006, and at the time of making the request for consideration of deferred action with USCIS;
  • You are currently in school, have graduated from high school, have obtained a GED, or have been honorably discharged from the Coast Guard or armed forces;
  • Have not been convicted of a felony offense, a significant misdemeanor, or more than three misdemeanors of any kind.
